TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCAPE-OLOGY LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
Either party may terminate these Terms at any time. You may cancel your subscription through your account settings. We may terminate or suspend your account immediately if you violate these Terms. Upon termination, your right to access the Service ceases. We will retain your data for 30 days following termination, after which it may be permanently deleted.
These Terms are governed by the laws of the State of Missouri, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the courts of St. Louis County, Missouri.
We reserve the right to modify these Terms at any time. We will notify you of material changes via email or prominent notice within the Service. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
